The WCB PIR auto-pays up to 10 percent premium back to COR-certified construction employers, no application required. Westray Law means any director, officer, or supervisor who failed to take reasonable steps to prevent a workplace death or injury faces personal criminal liability. The evidence trail has to exist before the incident, not after.

Where Nova Scotia operators get caught

  • Westray Law: directors, officers, and supervisors are personally on the hook

    Section 217.1 of the Criminal Code, known as the Westray Law, imposes a legal duty on every person who directs work to take reasonable steps to prevent bodily harm from that work. A supervisor, a director, or a safety manager who fails to take reasonable steps can face personal criminal liability if a worker is seriously injured or killed. The 1992 Westray Mine disaster in Pictou County, Nova Scotia, was the event that drove Canada to pass this law. No other province carries that local memory as directly as NS.

  • WCB PIR pays up to 10 percent back, but only if the evidence trail is maintained

    Nova Scotia's Practice Incentive Rebate auto-pays construction and trucking employers holding COR or WCB Safety Certified, up to 10 percent premium back, with no application required. The rebate is automatic for eligible employers, but eligibility requires maintaining active COR or WCB Safety Certified status through an audit cycle. Let the status lapse and the rebate lapses with it. The portal is the evidence trail that keeps the status current.

  • Bill 464 (2024): psychological health mandatory as of September 2025

    Nova Scotia's Stronger Workplaces Act (Bill 464, Royal Assent September 2024) expanded the definition of health and safety to include psychological health and made a written workplace harassment prevention policy mandatory for every NS employer, effective September 1, 2025. Every NS employer, from a two-person fishing operation to a major construction firm, now must have a written policy in place. This is not a voluntary best practice - it is a statutory requirement.

Some NS operators qualify for both. Choosing the wrong pathway means an audit that does not satisfy the certifying body the customer or WCB expects. PIR eligibility depends on holding the right certification for your sector.
